Terms and Conditions for VISATRACK CANADA

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OUR SERVICE. THIS IS A LEGALLY BINDING AGREEMENT.
IMPORTANT NOTICE: VISATRACK CANADA IS AN INDEPENDENT THIRD-PARTY SOFTWARE SERVICE. WE ARE NOT AFFILIATED WITH, ENDORSED BY, OR IN ANY WAY PARTNERED WITH THE U.S. DEPARTMENT OF STATE, THE U.S. GOVERNMENT, THE GOVERNMENT OF CANADA, OR ANY OTHER GOVERNMENTAL AGENCY. OUR SERVICE PROVIDES AUTOMATED NOTIFICATIONS REGARDING PUBLICLY AVAILABLE INFORMATION AND DOES NOT PROVIDE LEGAL OR IMMIGRATION ADVICE.
1. Acceptance of Terms
By accessing our website and using the services provided by VISATRACK CANADA (“Service”), which is owned and operated by 17385307 CANADA LTÉE (“Company,” “we,” “us,” or “our”), you (“User,” “you,” “your”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use our Service.
2. Description of Service
The Service is a third-party, automated software tool that monitors publicly available appointment slots for U.S. consulate services in Canada. Upon detection of an available appointment slot that meets the criteria you provide, the Service will send a notification to the email address and/or phone number you have provided.
The Service strictly DOES:
- Monitor publicly available data for appointment openings.
- Send automated notifications when a slot matching your criteria is detected.
The Service strictly DOES NOT:
- Guarantee the availability of any appointment slot.
- Guarantee that you will be successful in booking a notified slot.
- Book, hold, or reserve an appointment on your behalf.
- Access, request, or store your login credentials for any government portal.
- Provide any legal, immigration, or application advice.
- Collect or process any government fees.
3. Disclaimers and No Guarantees
- No Affiliation: You expressly acknowledge that the Company is not a government body and has no affiliation with any government entity. Any mention of U.S. consulates or visa appointments is for descriptive purposes only.
- No Guarantee of Availability: The availability of appointment slots is controlled entirely by the U.S. Department of State and its scheduling systems. We have no control over when, or if, new slots will be released. Our Service does not create or generate appointments; it only reports on their availability. Payment for our Service is for the monitoring effort, not for a guaranteed result.
- Information “As Is”: The information provided in our notifications is based on the data available on the official scheduling portal at the time of monitoring. We are not responsible for any inaccuracies, errors, or changes on the official portal.
- Service Uptime: We will use commercially reasonable efforts to ensure the Service is available 24/7. However, we do not guarantee uninterrupted service. The Service may be unavailable due to maintenance, technical issues, or factors beyond our control (e.g., changes to the government portal).
4. User Obligations and Responsibilities
- Accurate Information: You are solely responsible for providing a correct and active email address and/or phone number for notifications. We are not liable for any missed notifications due to user error (e.g., typos, spam filters, full inboxes).
- Timely Action: Appointment slots are extremely time-sensitive and are often booked within seconds of becoming available. You acknowledge that you must act immediately upon receiving a notification to have the best chance of securing a slot. A delay of even a few minutes will likely result in the slot being taken by someone else.
- Booking Responsibility: You are solely responsible for logging into the official government portal with your own credentials and completing the booking process for any appointment. We are not liable for any errors you make during the booking process.
- Compliance: You agree to use our Service for its intended purpose only and in compliance with all applicable laws and the terms of service of the official government scheduling portal.
5. Fees, Payments, and NO REFUND POLICY
- Fees: You agree to pay all applicable fees for the service tier you select. The fee is for access to our automated monitoring and notification Service for a defined term.
- Authorization: By providing a payment method, you expressly authorize us (or our third-party payment processor, Stripe) to charge you for the selected Service.
- NO REFUND POLICY:ALL FEES PAID ARE NON-REFUNDABLE. The Service’s resources are deployed immediately upon payment to begin monitoring for your requested criteria. Because we incur costs and provide value from the moment of purchase, we do not offer refunds for any reason, including but not limited to:
- If you fail to book a notified appointment slot.
- If no appointment slots become available during your service term.
- If you find an appointment through other means.
- If your visa application is denied.
- If you change your mind.
- Chargebacks: You agree not to initiate any chargebacks with your credit card provider. In the event of a payment dispute, you agree to contact us directly at support@expediteusvisabooking.ca to seek a resolution. If you initiate a chargeback, we reserve the right to present these Terms and your acceptance of them (via the mandatory checkout checkbox) as evidence that you agreed to our No Refund Policy and authorized the charge.
6. Term and Termination
The Service is considered complete and the term of our agreement ends upon the first successful notification of an available appointment slot that meets the User’s initial criteria. We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR USE OF THE SERVICE; (II) YOUR INABILITY TO SECURE AN APPOINTMENT; (III) ANY ERRORS OR OMISSIONS IN THE SERVICE; (IV) ANY FINANCIAL LOSSES, TRAVEL COSTS, OR OTHER EXPENSES INCURRED IN RELATION TO YOUR APPOINTMENT SCHEDULING.
OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF YOUR USE OF THE SERVICE IS STRICTLY LIMITED TO THE AMOUNT YOU PAID TO US FOR THE SERVICE.
8. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of your use and access of the Service.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days’ notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
